We understand that Community Associations are run by volunteers with ever increasing budget constraints.  We understand that Community Associations are small businesses, with ever increasing concerns about legal risk and compliance.  When the Board has legal questions, a call to an attorney can cost hundreds if not thousands of dollars.  All too often, that call is never made, and the Board is faced with decision making that can have long lasting legal and financial implications for the Association.  But what if an Association could budget for that legal expense? What if that phone call could be made without any additional cost to the Association, and all those operational and strategic questions and decisions could be supported by legal counsel with decades of experience in managing and providing legal counsel to Community Associations?

What Is It?

Flat rate legal services for Community Associations.  For a pre-determined fee, the Association receives unlimited covered legal services.

How Does It Work?

The Association signs an engagement letter outlining all of the legal services offered as part of Association RiskGuard.  Once signed, the designated Board Liaison and Community Manager (as applicable) are able to reach out to Neumyer Law, LLC and take advantage of all covered legal services.

Association RiskGuard is priced based on the number of units within the Community Association.  See below for specific pricing.

Association RiskGuard gives the designated Board Liaison and Community Manager unlimited access to an attorney for all of the day-to-day questions that arise in governing and managing Community Associations.  Responses are typically by email or phone, meaning attorney responses to emails and phone calls are included in Association RiskGuard.  Think of it this way - Association RiskGuard is like having an attorney attend your Board Meeting and provide you with immediate responses and guidance to the routine issues/questions that arise during the meeting.  Included guidance and advice includes the following:  


  • Reviewing and interpreting governing documents (declarations, bylaws, rules and regulations);
  • Providing guidance and advice on handling architectural requests, resale certificates, violations of the restrictive covenants, collection matters, special assessments, capital projects, contract disputes and meeting and voting procedures;
  • Providing guidance and advice on compliance with the PA Uniform Planned Community and Condominium Acts;
  • Providing guidance and advice on requests for accommodation under fair housing and discrimination laws;
  • Providing guidance and advice on insurance related matters (general liability, property and D&O coverages); and
  • Providing guidance and advice on best practices and risk mitigation strategies.


what is not covered

Association RiskGuard is designed to provide Community Associations with soft counseling services - namely emails and phone calls - to help with the everyday questions and concerns that arise in Community Associations and help Boards and Community Managers to mitigate risk.  Association RiskGuard does not include: 

 

  • Drafting amendments to governing documents (declarations, bylaws, rules and regulations);
  • Written opinion letters; 
  • Providing legal representation to the Community Association in administrative or other legal proceedings;
  • Providing written responses to complaints, letters, or other correspondence received by the Community Association;  
  • Providing any insurance related defense; 
  • Contract review that includes red-line edits; and
  • Attending meetings.

what does association riskguard cost

Cost is determined by the number of units within the Community Association.  The minimum monthly fee is $200 ($2,400 annually).  Otherwise, Association RiskGuard is priced at $.95 per unit, per month.  This service is billed annually, with payment for the upcoming year due in January.  If a Community Association requires legal services that are outside the scope of Association RiskGuard, additional legal services are available as follows: 

  • Collection Letter - $90
  • All other services are billed at the discounted rate of $200/hour.
  • Administrative expense billed separately (mileage, postage, office expense, etc.)
